Eligible Class Members:
All persons or entities who purchased Potash (as defined below) in the United States between July 1, 2003 and January 30, 2013 directly from any of the following companies: Agrium Inc., Agrium U.S. Inc. (collectively, “Agrium”), Mosaic Company, Mosaic Crop Nutrition L.L.C. (collectively “Mosaic”), Potash Corporation of Saskatchewan, Inc. (“Potash Corp.”), PCS Sales (USA), Inc. (“PCS Sales”), JSC Uralkali (“Uralkali”), JSC Silvinit (“Silvinit”) (collectively, the “Defendants”) or their affiliates JSC Belarusian Potash Company, BPC Chicago L.L.C. (collectively, “BPC”) and JSC International Potash Company (“IPC”).
Several lawsuits were originally filed regarding this matter prior to 2009 and the cases were consolidated before Judge Castillo in the Northern District of Illinois. In July 2009, Plaintiffs filed a consolidated amended complaint against the Defendants. Since then, the court determined that this case may proceed as a class action and granted preliminary approval of a settlement with Uralkali and Silvinit in the amount of $10,000,000. This settlement will be presented to the court for final approval in June 2013 and the litigation is ongoing with the remaining non-settling Defendants. Please note there is also a class action pending before Judge Castillo for all persons or entities that indirectly purchased Potash from the Defendants detailed above during the same covered period. The class is seeking injunctive relief and money damages in this matter. We will advise you of any potential future settlements related to such indirect purchases as well.

“Potash” is a key agricultural fertilizer which farmers throughout the world use to help crops fight disease and to enhance crop yields. It is a source of soluble potassium, which is one of three primary nutrients required for plant growth and maturation. Other commercial uses of potash include industrial applications in metal plating, and production of glass, ceramics, soaps, and animal feed supplements.
